IMPORTANT: PLEASE READ THESE TERMS CAREFULLY, INCLUDING THE HEALTH DISCLAIMER, ASSUMPTION OF RISK, ACCOUNT TERMINATION, LIMITATION OF LIABILITY, ARBITRATION, AND DISPUTE RESOLUTION PROVISIONS.
BY CREATING AN ACCOUNT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
ARTICLE 1: DESCRIPTION OF SERVICE
The W.ALLfit Application is a mobile and web fitness platform operated by Women All Fit SARL, a company incorporated under Moroccan law.
The Application provides: (a) Personalized workout programs; (b) Strength training exercises with instructions; (c) Nutritional information and meal planning; (d) Progress tracking.
ARTICLE 2: ELIGIBILITY AND REGISTRATION
2.1 Age Requirement: You must be at least 18 years old or the age of majority in your jurisdiction to use this Application.
2.2 AGE VERIFICATION AND USER RESPONSIBILITY: During registration, you will be required to confirm your date of birth. By entering your date of birth and checking the age confirmation box, you certify under penalty of account termination that you are at least 18 years old. We reserve the right to request additional age verification documentation at any time. Accounts found to belong to users under 18 will be immediately terminated without refund.
2.3 MISREPRESENTATION OF AGE - FULL LIABILITY: IF YOU PROVIDE FALSE INFORMATION REGARDING YOUR AGE, YOU ASSUME FULL AND COMPLETE RESPONSIBILITY FOR ALL CONSEQUENCES ARISING FROM YOUR USE OF THE APPLICATION. You agree that: (a) Women All Fit SARL shall bear no liability whatsoever for any injury, harm, or damages resulting from your use of the Application while under the legal age; (b) you (or your legal guardian) shall indemnify and hold harmless Women All Fit SARL against any and all claims, damages, costs, and legal fees arising from your misrepresentation of age; (c) any injury or harm sustained while using the Application as an underage user is solely your responsibility; (d) this clause survives termination of your account.
2.4 Health Requirements: You represent that you: (a) are in good physical health; (b) have consulted with a healthcare provider if you have any health concerns; (c) will stop immediately if you experience pain or adverse symptoms.
2.5 Account Accuracy: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
ARTICLE 3: HEALTH DISCLAIMER AND ASSUMPTION OF RISK
3.1 NOT MEDICAL ADVICE: W.ALLFIT PROVIDES FITNESS AND NUTRITIONAL INFORMATION FOR EDUCATIONAL PURPOSES ONLY. THIS IS NOT MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
3.2 Doctor Consultation Required: Consult a healthcare provider before starting any exercise program if you: (a) have a pre-existing medical condition; (b) are pregnant or postpartum; (c) have heart disease or high blood pressure; (d) are over 40 and sedentary.
3.3 Metric Accuracy: While we strive for accuracy, calorie burns, heart rate zones, and other metrics are estimates and may vary based on individual factors.
3.4 Contraindications: Stop exercising immediately and seek medical attention if you experience: chest pain, dizziness, fainting, severe shortness of breath, or unusual pain.
3.5 ASSUMPTION OF RISK: YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF THE APPLICATION AND ANY EXERCISE PROGRAM, INCLUDING RISK OF INJURY, ILLNESS, OR DEATH.
ARTICLE 4: ACCESSIBILITY
4.1 Commitment to Accessibility: We are committed to making our Application accessible to all users, including those with disabilities. We strive to follow Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards where technically feasible.
4.2 Accessibility Features: We aim to provide: (a) Text alternatives for images; (b) Sufficient color contrast; (c) Keyboard navigation support; (d) Screen reader compatibility; (e) Resizable text options.
4.3 Limitations: Some fitness content, particularly video demonstrations, may have inherent accessibility limitations. We are continuously working to improve accessibility.
4.4 Feedback: If you encounter accessibility barriers or have suggestions for improvement, please contact us at team@w-allfit.com with "Accessibility" in the subject line. We will respond within 10 business days.
4.5 Alternative Formats: Upon request, we will make reasonable efforts to provide workout instructions in alternative formats (text descriptions, audio guides) for users who cannot access video content.
ARTICLE 5: PAYMENT TERMS
5.1 Currencies: iOS (iPhone only; iPad not supported): USD via Apple In-App Purchase. Android/Web: MAD via LemonSqueezy.
5.2 Payment Methods: iOS: Apple In-App Purchase. Android/Web: Credit/debit card via LemonSqueezy.
ARTICLE 6: SUBSCRIPTION TERMS
6.1 Plans: Monthly (recurring), Quarterly (recurring), Annual (one-time payment for 12-month access).
6.2 All prices are exclusive of applicable taxes. MAD prices apply to Morocco; USD prices for international users via iOS.
ARTICLE 7: FREE TRIAL
7.1 Eligibility: One free trial per person.
7.2 AUTOMATIC CONVERSION: AT THE END OF YOUR FREE TRIAL, YOUR SUBSCRIPTION WILL AUTOMATICALLY CONVERT TO A PAID SUBSCRIPTION AND YOU WILL BE CHARGED UNLESS YOU CANCEL BEFORE THE TRIAL ENDS.
7.3 TRIAL ABUSE PREVENTION: We reserve the right to deny, revoke, or cancel free trials for users we reasonably believe have previously used a trial period, including detection through device identifiers, payment methods, IP addresses, or usage patterns. Creating multiple accounts to abuse free trials is strictly prohibited and constitutes grounds for permanent ban from the Application and all associated services.
ARTICLE 8: AUTO-RENEWAL AND CANCELLATION
8.1 AUTO-RENEWAL: YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW UNLESS YOU CANCEL BEFORE THE RENEWAL DATE.
8.2 Renewal Notification (Moroccan Law 31-08 Compliance): In compliance with Moroccan Law 31-08, WE (Women All Fit SARL) will send you a renewal reminder email at least SEVEN (7) DAYS before your subscription renewal date. This is our direct notification to you, separate from any notifications your payment processor may or may not send.
IMPORTANT NOTICE ABOUT PAYMENT PROCESSOR NOTIFICATIONS:
- LemonSqueezy (Android/Web): Sends automatic renewal reminders 7 days before renewal.
- Apple (iOS): Does NOT send advance renewal notifications for regular renewals. Apple charges automatically without prior notice.
Regardless of payment processor behavior, we commit to sending you our own reminder email at least 7 days before renewal.
8.3 How to Cancel: You can cancel your subscription at any time through:

You must cancel at least 24 hours before your renewal date to avoid being charged.
8.4 Cancellation Support: For assistance with cancellation, contact team@w-allfit.com.
ARTICLE 9: WITHDRAWAL RIGHT (Moroccan Law 31-08)
9.1 Seven-Day Right: Under Moroccan Law 31-08 Article 36, you have SEVEN (7) DAYS from purchase to withdraw without penalty.
9.2 Exception for Services Already Used: Per Article 38, if you begin using the service, you waive your withdrawal right for the service already consumed. For clarity, "beginning to use the service" means any of the following actions: (a) starting, viewing, or completing any workout session; (b) accessing any nutrition plan, meal plan, or recipe content; (c) logging any fitness or nutrition data; (d) downloading or accessing any premium content beyond the app interface. Simply creating an account or browsing the app interface does NOT constitute service use for withdrawal purposes.
9.3 How to Withdraw: Email team@w-allfit.com within 7 days of purchase stating your wish to withdraw. Include your account email and order details.
9.4 Refund Timeline: Per Article 37, valid withdrawals will be refunded within FIFTEEN (15) DAYS.
ARTICLE 10: REFUND POLICY
10.1 No Refunds After 7 Days: After the withdrawal period, subscriptions are non-refundable except as required by law.
10.2 Exceptions: We may consider refunds for: (a) technical issues preventing service access (verified by our support team); (b) duplicate charges (with proof).
10.3 No Refund for Forgotten Cancellation: If your subscription auto-renews because you didn't cancel, we are not obligated to refund.
ARTICLE 11: ACCOUNT TERMINATION BY COMPANY
11.1 Termination for Cause (Immediate, No Refund): We may terminate immediately without notice if you: (a) violate these Terms or any law; (b) engage in fraud or provide false information; (c) pose a security risk; (d) use the Application illegally; (e) harass or harm other users; (f) attempt to hack or reverse engineer the Application; (g) create multiple accounts to abuse promotions; (h) misrepresent your age; or (i) damage our reputation or business.
11.2 Termination for Convenience (30 Days Notice, Pro-Rata Refund): We may terminate for any other reason with 30 days written notice. You will receive a pro-rata refund for unused subscription time.
11.3 Termination for Inactivity: Accounts inactive for 24+ months may be closed after 30 days notice to your registered email.
11.4 Termination for Non-Payment: After a 7-day cure period for failed payments, we may terminate your account.
ARTICLE 12: ACCOUNT TERMINATION BY USER
12.1 Right to Terminate: You may terminate at any time by: (a) canceling your subscription through the app or website; and (b) requesting account deletion via app settings or team@w-allfit.com.
12.2 Data Export: You have 30 days from termination request to export your data.
12.3 No Prorated Refunds: Voluntary mid-subscription cancellation does not entitle you to a refund, but access continues until the paid period ends.
ARTICLE 13: APPEAL PROCESS FOR TERMINATION
13.1 Right to Appeal: You may appeal termination decisions within 30 days by emailing team@w-allfit.com with subject "Account Termination Appeal".
13.2 Review: We will review your appeal and respond within 15 business days.
13.3 Final Decision: Our decision on appeal is final.
ARTICLE 14: SERVICE DISCONTINUATION
14.1 If we discontinue the Application entirely, we will provide 60 days notice and pro-rata refunds for unused prepaid subscription time.
ARTICLE 15: USER CONTENT
15.1 License Grant for App Use: By submitting content (photos, comments, feedback), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content within the Application for service delivery purposes.
15.2 Marketing Use - Separate Consent Required: We will NOT use your photos, progress images, testimonials, or personal content for marketing, advertising, social media, or promotional purposes without obtaining your separate, explicit written consent. If you wish to allow such use, you may opt-in through your account settings or by contacting us directly.
15.3 Image Rights: You confirm you have the right to share any photos you upload and that they do not infringe third-party rights.
15.4 No Compensation: You are not entitled to compensation for your User Content used within the Application. Marketing use with your consent may be subject to separate agreement.
ARTICLE 16: THIRD-PARTY SERVICES
16.1 Third-Party Services: The Application may integrate with third-party services. When third-party integrations are added in the future, their respective terms and privacy policies will apply.
16.2 Third-Party Responsibility: We are not responsible for the availability, accuracy, or functionality of third-party services.
ARTICLE 17: BETA FEATURES
17.1 We may offer beta features marked as "Beta" or "Preview".
17.2 Beta features are provided "AS IS" without warranty and may be modified or discontinued at any time.
ARTICLE 18: LIMITATION OF LIABILITY
18.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
18.2 MONETARY CAP: For claims other than personal injury, our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
18.3 PERSONAL INJURY DISCLAIMER: As stated in Article 3, you assume all risks associated with physical exercise. We provide informational content only, not supervised training. Any injury resulting from your exercise activities is your sole responsibility, as you control how, when, and whether to perform any exercise. This limitation does not apply to liability that cannot be excluded under applicable Moroccan law.
18.4 NO LIABILITY FOR USER MISREPRESENTATION: We shall have no liability whatsoever for any damages, injuries, or losses arising from your provision of false information, including but not limited to misrepresentation of age, health status, or fitness level.
ARTICLE 19: INDEMNIFICATION
19.1 You agree to indemnify and hold harmless Women All Fit SARL, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from: (a) your use of the Application; (b) your violation of these Terms; (c) your User Content; (d) your violation of any third-party rights; (e) any misrepresentation of your age or eligibility.
ARTICLE 20: ARBITRATION AND CLASS ACTION WAIVER
20.1 Binding Arbitration: Except for IP disputes or small claims, disputes shall be resolved by binding arbitration in Casablanca under CIMAC (Centre International de Médiation et d'Arbitrage de Casablanca) rules.
20.2 CLASS ACTION WAIVER: YOU AND Women All Fit SARL AGREE THAT DISPUTES WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS, NOT AS A CLASS ACTION OR REPRESENTATIVE ACTION.
20.3 Opt-Out Right: You may opt out within 30 DAYS of first accepting by emailing team@w-allfit.com with subject "Arbitration Opt-Out".
20.4 Informal Resolution First: Before arbitration, both parties agree to attempt informal resolution for 60 days.
20.5 Arbitration Fees: Each party shall bear its own costs, fees, and expenses, including arbitration filing fees and legal representation costs.
ARTICLE 21: FORCE MAJEURE
21.1 We are not liable for failures due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, strikes, government actions, or internet/infrastructure failures.
ARTICLE 22: INTELLECTUAL PROPERTY
22.1 All intellectual property rights belong to Women All Fit SARL or its licensors.
22.2 PROHIBITED CONTENT USE: You are expressly prohibited from:
(a) Copying, reproducing, downloading, or storing any workout programs, exercise routines, nutrition plans, meal plans, recipes, or any other content from the Application for use outside your personal subscription;
(b) Using any content from the Application for commercial purposes, including but not limited to: training clients, creating competing products, reselling, redistributing, or sharing with third parties;
(c) Screenshotting, screen recording, or otherwise capturing content to share with others or use after your subscription ends;
(d) Creating derivative works based on our workout programs, nutrition plans, or other proprietary content;
(e) Sharing your account credentials with others to allow them access to our content;
(f) Recreating, rewriting, or reproducing our workout programs, exercise sequences, nutrition protocols, meal plans, or recipes in any form (written, digital, or verbal), even from memory, for any commercial purpose;
(g) Teaching, coaching, or verbally transmitting our proprietary workout methodologies, exercise sequences, nutritional protocols, or any other content to third parties for commercial purposes, including but not limited to: personal training clients, fitness classes, group coaching, online courses, or any paid services;
(h) Circumventing, disabling, or interfering with any security features or content protection measures implemented in the Application.
22.3 CONTENT LICENSE: Your subscription grants you a LIMITED, NON-TRANSFERABLE, NON-EXCLUSIVE, REVOCABLE license to access and use the content solely for your own personal, non-commercial fitness purposes during your active subscription period.
22.4 TERMINATION OF LICENSE: Upon cancellation or termination of your subscription, your license to use all content immediately terminates. You may not retain, use, or reference any content for commercial purposes.
22.5 TECHNICAL PROTECTION: The Application implements security measures to protect our proprietary content. You acknowledge that: (a) these measures are designed to prevent unauthorized copying, downloading, and redistribution of content; (b) any attempt to circumvent, disable, or interfere with these protections is strictly prohibited and constitutes a material breach of these Terms; (c) circumvention of technical protection measures may also violate applicable laws.
22.6 CONTENT THEFT REPORTING: If you become aware of any unauthorized use, copying, or distribution of our content by any person (including other users), please report it immediately to team@w-allfit.com with subject "Content Theft Report". We take all reports seriously and will investigate promptly. Users who report verified content theft in good faith may be eligible for account credits at our discretion.
22.7 ENFORCEMENT: Violation of these content usage restrictions constitutes a material breach of these Terms and grounds for immediate account termination without refund. We reserve the right to pursue legal action for damages, including but not limited to: lost profits, statutory damages, injunctive relief, and attorney fees. We actively monitor for content theft and will pursue all available legal remedies against infringers.
ARTICLE 23: MODIFICATIONS
23.1 We may modify these Terms with 30 days notice for material changes. Continued use after notice constitutes acceptance.
ARTICLE 24: GOVERNING LAW
24.1 These Terms are governed by Moroccan law.
24.2 In case of conflict between language versions, the Arabic version shall prevail as required by Moroccan law.
ARTICLE 25: SEVERABILITY
25.1 If any provision is found unenforceable, the remaining provisions continue in effect.
ARTICLE 26: ENTIRE AGREEMENT
26.1 These Terms constitute the entire agreement between you and Women All Fit SARL.
